The nutry4ALL websites provide their Users with content on supplementation, nutrition, food and other analogues in text, image and video format, and access to some of these contents may depend on the User's prior registration, under the terms mentioned below.

The information contained on the nutry4ALL websites should not be understood as therapeutic recommendations, nor in any way replace the advice and recommendations of specialized health professionals, not exempting the consultation of these professionals to obtain detailed information about particular and specific situations. In any case, nutry4ALL does not guarantee that the quality, features and/or characteristics of any products, services or information available on the websites, meet the User's expectations in relation to them, as there are some variables that depend exclusively on the user, such as respect for daily intakes, knowledge of allergic effects, previous pathologies, among others.

Users may freely view the contents made available and reproduce them, exclusively for private purposes and/or professional use, in accordance with the rules established below regarding “Use”. It is expressly prohibited to use nutry4ALL's websites for commercial purposes, for illegal purposes and/or for any other purposes that may, directly or indirectly, be considered harmful to the image and good name of nutry4ALL or any company of the nutry4ALL Group.

The use and navigation on nutry4ALL Sites may allow or even lead to hyperlinks to other sites, as well as refer to information, questions, opinions, ideas, suggestions and/or even comments made by Users of these other sites. In these cases, the hyperlinks are provided solely for the convenience and accessibility of the User, and there is, in no case, any relationship between nutry4ALL and the owner or manager of the website to which the link may refer, nor the acceptance or approval by nutry4ALL of any of the contents, services or products made available there. To this extent, nutry4ALL is not responsible for the content of third-party websites, and the User is entirely responsible for accessing and visiting them.

The User recognizes the right of nutry4ALL to limit access and publication of opinions, information and/or comments from Users on its websites, and may install, if it so wishes, selection filters for this purpose. nutry4ALL also reserves the right to change the presentation, configuration and location of its websites, as well as modify, suspend or interrupt the respective options and functionalities, as well as the conditions and access requirements, at any time and without the need for early warning.

4. Use

The User undertakes to make a correct, prudent and adequate use of nutry4ALL websites, in strict compliance with these Terms of Use and any additional instructions that may be communicated or made available by nutry4ALL on its websites.

In cases where access to and use of a particular nutry4ALL website requires prior registration, the User undertakes to keep the password and username assigned or created by him/her in secrecy, which are personal and non-transferable. The user is solely responsible for not disclosing his password and username to third parties and for not browsing the Internet under conditions that allow their decoding and eventual access or copying by third parties.

The User undertakes not to use nutry4ALL's websites in a way that may prevent, disturb or degrade their normal operation and access by other Users or in terms that may directly or indirectly cause any damage to nutry4ALL, its suppliers, other Users and/or any third party. The User undertakes, in particular, to:

Not to use the contents of the websites in a way that is considered illegal, or in conjunction or association with images or other content that contains pornography, violent acts or incitement to violence, illegal, unfair, obscene or defamatory acts towards any person and/or goods or that promote racial or sexual discrimination;

Do not use the contents of the nutry4ALL websites in terms that, directly or indirectly, violate: (i) the intellectual property rights of nutry4ALL, the other companies of the nutry4ALL Group and/or third parties, (ii) the personality rights of third parties, such as the right to image and privacy; (iii) personal data protection rules (iv) confidentiality duties or that (v) in general, may negatively affect the image of nutry4ALL or any other company of the nutry4ALL Group;

Do not post any information, opinions or comments on the websites, namely those that in any way violate the rights of third parties and/or the image of nutry4ALL or any other company of the nutry4ALL Group;

Not to introduce or disseminate through the nutry4ALL websites, viruses, computer codes, files or any program that may damage, alter or delete the contents made available on the websites, as well as interrupt, destroy or limit the functionality of any computer, computer system or communications;

Not to publish or in any way make available on the nutry4ALL websites links to other websites and/or any messages, namely messages of an advertising or commercial nature;

Do not access or attempt to access nutry4ALL websites through other means or procedures that are provided by nutri4ALL, namely through the violation or attempted violation of any authentication or security system that protects access accounts, servers, services or networks or that affect the functionality and availability of nutri4ALL websites;

Do not use technical or logical resources through which any third party can benefit, directly or indirectly, from the contents of the websites, namely through the insertion or creation of a hypertext or similar link towards the websites, without prejudice to the provisions below. about “Intellectual Property”;

Not to create a false identity, except in the case of pseudonyms (nicknames, nicknames) or in any way to impersonate another person, natural or legal, nor to use the password and username of third parties to access the sites;

5. Intellectual property

The information contained in the nutry4ALL websites is the property of the latter, so it is exclusively responsible for the structure, selection, organization and presentation of its content, including its features and the software used on the websites.

All texts, graphics, videos, images or other elements contained in the websites belong exclusively to nutry4ALL or to the entities that authorized their use.

The User will respect and will have the intellectual property rights on the websites respected by third parties, refraining from (i) using them for purposes not mentioned in these Terms of Use without the express authorization of nutry4ALL, and (ii) proceeding with the reproduction, modification, transformation, decompilation, distribution, making available to third parties and use of modified forms of software, in particular with the aim of obtaining unauthorized access to the websites.

The User authorizes nutry4ALL, free of charge, to use, in any way, in whole or in part, the information made available on the websites, including its reproduction, distribution and making available to the public, as well as to modify and transformation, for the purposes of promoting the websites and disseminating the information contained therein, without prejudice to the protection of personal data contained in the Privacy Policy.

The intellectual property rights over the brands, logos or other identifying elements contained in the websites belong to the respective entities, and the User cannot use them, in any way, without their express and prior authorization.

The use of the contents of the sites, when it has been expressly and previously authorized, must make clear mention of its source, that is, nutry4ALL and the URL of the sites. In this case, the availability of the contents to third parties must be made in a way that prevents their reproduction, modification and/or transformation, and informing the corresponding user of the conditions of responsibility of nutry4ALL for the contents, in accordance with the following point.

6. Responsability

Without prejudice to the legal regime of civil liability, nutry4ALL will not be liable to the User, namely:

For lost profits, indirect damages, loss or damage of data;

For any damages suffered by the User and/or by third parties, resulting from the use or impossibility of using the websites, due to delays, interruptions, errors, interferences and suspensions of communications and loss of information in that sequence, namely, any deficiencies or failures caused by the communications network or communications services provided by third parties, by the computer system, by the modems, by the software, or any computer viruses or resulting from the download of infected files or containing viruses or other properties that may affect the user's terminal equipment, namely when it does not install the appropriate software to protect access to the Internet;

For delays or blockages in the use of the websites, which are caused by deficiencies or unpredictable overload of the computer systems, namely, failures in accessing the websites;

For any damages suffered by the user and/or by third parties that may arise from any suspension, non-operation or unauthorized use of the servers on which the sites are hosted and/or of all the information and data stored there;

For possible errors or security deficiencies that may arise from the use, by the User, of an outdated or insecure browser, as well as the activation of the User's password and username storage devices, or for the damages, errors or inaccuracies that may result from its malfunction;

For the use of the password and username by unauthorized third parties, which is atributable to the user or third parties;

For the correctness, timeliness, accuracy or veracity of any advice, recommendation or information made available on the websites, as well as for any damage suffered by the User and/or third parties, resulting from errors, omissions, inaccuracies and outdated information provided on the websites;

For any information of any kind that is made available by users on the sites;

For the results obtained through hyperlinks, nutry4ALL does not guarantee that they are correct, true, updated or complete;

Due to the functioning, availability and accessibility of the websites to which the websites refer through hyperlinks, continuity of information, content and services on those websites, quality, legality, reliability, correctness and usefulness of the information, content and services existing therein, as well as for any information, product or service that may be advertised in banners or any form of advertising on the websites;

For the non-fulfillment or defective fulfillment of its obligations under these Terms of Use that is, directly or indirectly, resulting from the fulfillment of judicial decisions or administrative authorities;

For the incorrect and illicit use of the websites and/or their contents by the User;

For non-compliance, delay or defective compliance that results from situations of force majeure, that is, situations beyond the control of nutry4ALL and that cannot be controlled by it, such as fires, power cuts, explosions, wars, riots, civil insurrections, government decisions , strikes, earthquakes, floods or other natural cataclysms or situations that prevent or jeopardize the fulfillment of the obligations assumed.

7. Delivery Policy

Users will receive the invoice via email always after the purchase has been formalized. A tracking number of the order will be sent, which can be followed via a hyperlink directed to the carrier's website, or, if applicable, you can follow the status of the order in your reserved area, respecting the deadlines for entering data on the nutri4ALL website. and/or carrier.

When logging in, the user will be able to view the entire history of pending or completed purchases in their personal area.

All orders will follow their natural delivery process, only on working days, with the exception of regional holidays only. Buyers may request delivery in an exceptional way, either deadlines or days of delivery, directly supporting the risks alluding to urgent processing. Orders are delivered to the address specified by the buyer in the formalization of payment.

The customer will be able to receive their orders at the addresses they choose, which will be excluded PO Boxes, for obvious reasons. Orders will be delivered on working days from 8am to 7pm, at the address indicated without the buyer's option to choose a time, given the logistics and operationality. Up to three delivery attempts will be made, which without success, the order is returned to nutry4ALL and the respective resending will be the responsibility of the buyer.

Users are advised to enter data correctly, as filling in an incorrect or incomplete delivery address will lead to its return to nutry4ALL, resulting in additional costs borne by users, so the correct insertion and confirmation of all data. Once processed and finalized, no changes to the data previously provided will be possible.

Chronopost

If the delivery is not successful, the recipient will be informed by means of a notice, in order to contact the carrier to reschedule a new delivery, it must be done within a maximum of 5 consecutive days because on the sixth day the order will be returned to nutry4all.

Tipsa

The order will be delivered either to the address indicated or at any other point designated by the buyer or assigned, exceptionally, by the carrier or nutry4ALL. If the delivery is not successful, the recipient will be informed by means of a notice, in order to contact the carrier to reschedule a new delivery, it must be done within a maximum of 5 consecutive days because on the sixth day the order will be returned to nutry4all.

Whenever it is unfeasible for the carrier to proceed with the respective notification, either due to incorrect or incomplete data provided, namely at the address, the order will be returned immediately to nutry4ALL, based on the absence of notification and the respective duty of information.

All deliveries to the address indicated by the user will be delivered between 09am and 19pm, and can be changed with the express indication of the recipient, subject to the availability of the carrier.

Delivery Times

Continental Portugal

After successful collection of any payment, which will result in the formalization of the purchase and respective dispatch of the order, nutry4ALL guarantees delivery within a maximum period of 48 hours, and the order may reach the recipient before this period.

Azores and Madeira

The period will vary according to the urgency of the buyer, since costs will be borne here. These shipments are only guaranteed by CTT EXPRESSO, so the deadline may vary depending on the shipping method chosen, see tables attached to the website.

Shipping Expenses

All shipping costs comply with evaluation parameters in order to bring the lowest possible cost. Therefore, they are calculated directly by internal computer systems and with the help and supervision of carriers for efficient synergies in protecting orders and respecting delivery times. These factors:

Order volume or weight, whichever is higher;

Total value of the order, benefiting from free deliveries for purchases of €30 or more to mainland Portugal;

Other destinations will have a variable value and we suggest the previous consultation of the tables in exa to the site;

Tables and tariffs of carriers, which may change at any time.

ORDERS WITHOUT SUCCESSFUL DELIVERY

Any pre-paid order, paid by means of Credit Card, PayPal, Multibanco, MBWay or Bank Transfer, which is not claimed by the buyer and subsequently returned to nutry4ALL for reasons not attributable to nutry4ALL or the carrier , it follows from the following:

nutry4ALL will refund the amount paid by it;

All shipping and return costs will be deducted from this return;

The return will be made through the means that causes the least damage to nutry4ALL;

The buyer may choose to translate the return into credit in a future purchase on the same platform/site, and may have the same for a maximum period of 12 months from the date of purchase.

In the case that the buyer has requested delivery for collection and the return of the order meets the above delivery failure requirements, without direct responsibility of the sender and the carrier, nutry4ALL will charge a fee of €6.5 on a future order. Facing the shipping and return costs of the order once returned.

We suggest that when sending an email to nutry4all, it comes with as much information as possible to facilitate the identification of the order. Name, address, order number and payment method. In case of return with exchange for a product of higher value, as well as the payment made in advance, the fee of € 6.5 will be exempt.

If the reason for non-delivery is due to the carrier without responsibility for the buyer, the customer must send a duplicate claim either to the carrier or to nutry4all so that the situation is analyzed promptly and with the least damage to all parts.

Whenever non-delivery is due to anomalous aspects such as: incorrect or incomplete address, we ask the buyer to attach proof of address (TV, water, electricity) to the claim.

The nutry4all will ensure the best solution for all parties, after determining the responsibilities in the face of the anomaly. For this reason, reimbursement, settlement of a new purchase or charge of postage on orders returned for reasons beyond nutry4all are foreseen.

Order Cancellation 

The buyer is allowed to cancel any purchase or order if payment is missing or in internal transit for dispatch. After payment, to proceed with the cancellation, you must send an email to Geral@nutry4all.com explaining the reason for the cancellation as well as the change to the purchase, after this procedure you will receive detailed information about it. nutry4all reserves the right to accept the cancellation and respective return.

Returns

In the case that the buyer feels the need to make a return, he/she can do so within 15 days, after receiving the products, if they are without any damage to the packaging or violation of the same, thus keeping it original.

You can request via the email address geral@nutry4all.com and the amount paid can be refunded or used as a credit for future purchases. Points earned will be withdrawn.

If the purchase includes any promotion or campaign aimed at offering one or more products, all products involved must be returned intact as they were sent.

The buyer must contact nutry4all via email geral@nutry4all.com so that they can agree on the way to return the products.

Any attempt to return items that demonstrate that they have been violated, rendered useless, used or belonging to a set and are incomplete, not complying with the aspects for return, will not be accepted.

All products whose validity period is less than 2 months are included in the non-acceptance of return, as well as products purchased through “nutripoints”.

The responsibility for the proper packaging and shipping of the returned products will be the responsibility of the buyer, if the packaging shows any type of damage, the return will be rejected.

Exchanges

The procedure for exchanges is the same as in the previous explanation of "Returns".

Reefund

For nutry4all, the satisfaction of our customers is a priority and as such will do everything possible, so that refunds are made as quickly as possible, it is important that product returns comply with the described and safeguarded deadlines. Refunds will be made no later than 15 days after receipt.

Payments made by paypal or credit card will be returned to the account and card and can be confirmed in the respective statements.

Other forms of payment will be requested bank details to proceed with the returns.

If you opt for a refund using a discount coupon, it will be valid for 12 months, after which the buyer will lose this right to a refund.

Refund of Shipping Expenses

Shipping costs can only be reimbursed if the reasons for the return are the responsibility of nutri4all. As an example the exchange of products or defects in them. This refund does not apply if multiple products have been ordered and only one is defective. This fact does not invalidate the exchange of the same product.

8. Suspension and desactivation of the Websites

The nutry4ALL may, at any time and regardless of prior communication, cancel access to one or more sites, whether for one, several or all Users.

The nutry4ALL also reserves the right to suspend, in whole or in part, or to immediately cease access to one or more websites, in the following cases:

Violation by the User of any of its obligations contained in these Terms of Use;

Termination of the accommodation contract with the entity that provides it;

By legal imposition or by a competent judicial or administrative authority;

In case of management, maintenance, repair, alteration or modernization operations of the sites.

The suspension or termination of one or more websites, for any reason, does not matter the User's right to any indemnity or compensation.

9. Changes

nutry4ALL reserves the right, at any time, without prior notice and with immediate effect, to modify, in whole or in part, these Terms of Use.

It is the User's duty to consult the Terms of Use in each access made to the websites, and must refrain from using them in the event of not agreeing with any of their rules.

10. Privacy and Personal Data

Users' personal data will be collected and treated in accordance with the legal rules in force and in accordance with the Privacy Policy on the websites and available in the Privacy Policy

12. Applicable law

These Terms of Use are governed by Portuguese Law. The nutry4ALL websites, policies, information and content are regulated by Portuguese legislation in force. nutry4ALL is not subject to compliance with any rules, procedures and/or legal, regulatory or any other requirements that result or may result from the legal framework of Users who are nationals of other countries or who reside there, nor does it assume any liability arising therefrom. .

In the event of a dispute, in the interpretation or application of these Terms of Use, the Portuguese Courts are competent, specifically those in the area of jurisdiction of Lisbon, with express waiver of any others.

13. Final dispositions

The declaration of invalidity, illegality or ineffectiveness of any provision of these Terms of Use will not affect the remaining provisions, which will continue in force.
